Our company aims to comply with all legal provisions in force regarding the protection of personal data, thus we comply with the provisions of EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as the provisions of Law 190 of 18 July 2018 on implementing measures for Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

For this reason, we make every effort to explain to you, through this Privacy Policy, in an understandable and clear way, how our company collects, stores, processes, transmits, and transfers information regarding your personal data.

What is personal data?

According to the definition of EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data 

"personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

"data controller" means, according to Article 4 of the General Data Protection Regulation, the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of the processing are determined by Union or national law, the controller or the specific criteria for his designation may be laid down in Union or national law

"processor" means the natural or legal person who processes personal data on behalf of the controller.

What personal data do we process, for what purpose and on what legal basis?

There is some information that we collect directly from you, and some that we receive from third parties and/or our partners if you order Products and/or Services from them from us.

Who receives your data?
Within this company, only those persons and services (e.g. specialist field) who need them to fulfill our contractual and legal obligations receive your personal data. 

In addition, to fulfill our contractual and legal obligations, we partially operate with various service providers (e.g. for shipping products). 1. Billing and delivery dates

If you wish to order any of our Products and/or Services, we ask that you provide us with the following valid, correct information in order to process the Order and deliver the products: name, surname, telephone number, e-mail address, delivery address and billing address.

3. Data processed for product returns

If you wish to exercise your right to return the Product, in order to fulfill our legal obligation and prevent any kind of abuse and fraud, we will request: identification data such as first and last name, delivery address, order identification data such as invoice number, product delivery date, reason for return and other observations from you, and in order to be able to keep in touch with you until the return process is resolved, we ask you to provide us with a valid e-mail address and a correct phone number.

The legal basis for this processing is the fulfillment of our legal obligations towards the Customer regarding the possibility of returning the product within the time limit and conditions provided by law.

3.1. Data processed for the purpose of guarantee redemption:

In order to exercise your right to claim the warranty regarding the Product/Service purchased, we request the following data from you: name, surname, invoice number and invoice date.

The legal basis for processing the above data is the fulfillment of our company's legal and contractual obligations regarding the warranty of the products sold.

We also use the personal data provided by you to:

You are not obliged to provide us with your personal data, but given the above processing purposes, we may not be able to fulfill some of your requests without providing this data, and thus you may not be able to benefit from some of the services of our website or your experience on our website may be different. 3.3. Personal data retention period

Our company retains your personal data for as long as necessary to fulfill the purpose for which it was provided, but no longer than 3 months (It is advisable to enter a data storage period as short as possible, except for those necessary for billing.) since the last visit to our website, or the last contact with you.

We primarily collect, store and process your personal data only to fulfill a contractual obligation to you or if you have given us your consent. However, we also use your data to comply with procedures or legal provisions that concern us, to the extent that this is necessary to protect our interests or those of our legitimate interests or to assert, protect or exercise our rights against certain claims.

4.2.1: In principle, you can use our website without having to directly communicate personal information to us. For certain services, for example, in the case of subscribing to the newsletter or if you wish to be a member of the “Danibrum Romania” community, it will be necessary for you to provide us with personal information. For this purpose, you will need to specify your name or your e-mail address, in order to benefit from the respective service. 
2.2.2: The analysis and processing of personal data is necessary in particular for the collection, processing and performance of reports, so that we can fulfill our contractual obligations. You can obtain additional data in this regard from the complementary information. 

4.3. Data we automatically obtain through your use of our online services
Certain data is already collected if you visit our website.

4.3.1 Protocol data
The automatically collected data includes web server log data. We only activate this logging in exceptional cases to examine support cases and ensure stability and security (Art. 6 para. 1 lit. f) DS-GVO). Each data set contains:

  • client and server IP address, port status and protocol
  • the name of the accessed file or website and the size of the request
  • login information for the respective web service to the extent that you log in with a user account
  • browser type and access point (last website accessed by the customer)
  • This data is evaluated anonymously and exclusively for technical purposes. No statistical evaluations are carried out.

4.3.2 Cookies
Cookies are small files containing a string of characters in which certain information is stored in an open or closed manner. Cookies are transmitted by the server to your device where they are stored. They are used to identify the device from which a website was accessed. If you log in to a website, cookies ensure communication of the connection to the server and verification of authorizations when accessing the website. Each cookie has a specific expiration date.
